When does “no” really mean NO, and how many times can you put someone on trial for attempted rape until you finally get a conviction?
The bizarre case of a horn-dog Naval officer who allegedly wouldn’t take “no” for an answer, just got weirder when federal prosecutors shockingly dismissed charges against 41 year-old Navy CDR John Neuhart. As of press time, we don’t have a clue why those charges were dropped.
Neuhart is former commanding officer of Helicopter Squadron 25 on Guam, which is an unincorporated and organized territory of the United States in Micronesia in the western Pacific Ocean. Commander Neuhart allegedly got liquored up with a female subordinate officer the night of Sept. 12, 2016, in a downtown San Diego bar. Security camera footage showed the duo hugging and kissing and so drunk they were seen staggering out of the drinking establishment.
TROUBLE WHEN SHE GOT HOME
It was at the “victim’s” house in the Valencia Park section of San Diego that things apparently got way out of hand. Neuhart, thinking he had a green light to get laid, put the moves on the female officer who loudly told him to stop and leave the premises.
The argument was so loud that it awakened a neighbor who shouted he had a gun and was calling the cops. Neuhart was soused, but not drunk enough to realize that he had stepped on his dick “big time.” Presumably as the cops arrived in the front of her home, the horn-dog commander scurried off into the dark canyon area behind the woman’s house and promptly fell and broke his leg. That was just the beginning of his problems.
At his previous trial, Neuhart denied any intention of raping the female lieutenant and claimed she had indicated to him that when she said “no” to his sexual advances, it actually meant “yes, keep going.” Yeah, right. And the dog ate my homework.
LIKELY NAVY WILL COURT-MARTIAL OFFICER
We don’t know why the feds gave up on trying to put Neuhart behind bars, but his troubles are far from over. The Navy has accepted jurisdiction in the sticky case (no pun intended) and chances are the three-striper will find himself on trial again, but this time before a military general court martial.
Fraternization, adultery and conduct-unbecoming-an-officer charges would seem to be a slam dunk against Commander Neuhart. But if the Judge Advocate General (JAG) can convince a jury Neuhart was insistent on sex with the woman, then he very well could face a conviction on attempted rape. And, that would translate into a lengthy stretch at the Detention Barracks (DB) in the military prison at Ft. Leavenworth, Kansas.
CDR Neuhart is the consummate dumb-ass naval officer and pilot. Our sympathies are with the woman who could have become a rape victim. Our sympathies are also with his wife and five children who have had their lives turned upside down by the actions of a husband and father, which Neuhart failed at miserably. Neuhart has been in the Navy 18 years, but his chances of ever collecting a pension are no better than zero.
